If your facility stores, transfers, or handles oil in aboveground containers with a combined storage capacity of more than 1,320 gallons, and there is a reasonable expectation that a discharge could reach navigable waters of the United States, you are subject to EPA’s SPCC Rule. That threshold is roughly 32 barrels, which means the majority of producing well sites, tank batteries, gathering stations, and processing facilities in the oil and gas industry fall under the regulation.

The SPCC Rule requires covered facilities to have a written plan that identifies potential spill sources, describes the containment and countermeasure systems in place to prevent discharges, and outlines the procedures your personnel will follow if a release occurs. The plan must be certified by a licensed Professional Engineer and reviewed at least once every five years or whenever facility conditions change.
